Terms and conditions
1. Scope
These terms apply to all orders placed in the online shop at roughbloom.ch. Your contracting party is Montana Meyer, Rough Bloom Ceramics (see legal notice). The version shown on this page at the time of your order applies.
2. The pieces
Every piece is hand-built from stoneware, glazed and fired to cone 6. Even pieces from the same series differ slightly. Colour, glaze flow, shape and size may differ slightly from the photo. Small irregularities such as glaze runs, specks in the clay or light crackle are part of the craft and are not defects.
3. Ordering and conclusion of the contract
An order works like this:
- On the piece you want, tap «Buy». You are taken to Stripe's secure payment page.
- There you choose the quantity, enter your delivery address and choose how to pay.
- Before you pay, you see the piece, price and shipping costs. Until then you can change everything or cancel.
- Clicking the pay button submits a binding order.
- You immediately receive a confirmation by email. The purchase contract is concluded once payment has been received.
Each piece is paid for separately. If you order several different pieces, I ship them in one parcel and refund the shipping costs you paid in excess.
If a piece shows «Order» instead of «Buy», you order by email. I will then send you a payment link.
Because every piece is one of a kind, it can rarely happen that a piece has just been sold at a market. If so, I will contact you straight away and refund the full amount.
4. Prices and shipping costs
All prices are final prices in Swiss francs (CHF). Shipping costs are added unless you pick the piece up in Basel. They depend on the weight of the parcel and are shown on the payment page before you submit your order.
5. Payment
You can pay by credit card, TWINT or Klarna. Payment is processed by Stripe Payments Europe, Limited, Dublin, Ireland (see privacy). Klarna's own terms also apply to Klarna payments.
6. Delivery
I only ship within Switzerland, with Swiss Post. Pieces marked «ready to ship» are posted within 5 working days of payment. Every piece is carefully packed.
On the payment page you can choose «Pickup in Basel» instead of shipping. No shipping costs apply then. After your order I will email you to arrange a place and time.
If a piece arrives damaged, please email a photo of the piece and the packaging to hello@roughbloom.ch within 7 days of receipt. You will then receive a replacement, if available, or a refund. Your statutory warranty rights remain unaffected.
7. Returns and exchanges
Swiss law does not provide a right of withdrawal for online purchases. Returns and exchanges are therefore not possible. Your rights in case of transport damage (section 6) and the statutory warranty (section 8) remain unaffected.
8. Warranty
The statutory warranty under Swiss law applies (Art. 197 et seq. of the Swiss Code of Obligations). For buyers who purchase a piece for private use, the warranty period is two years from delivery. Please report a defect as soon as you notice it. The characteristics of handmade work described in section 2 are not defects.
9. Liability
I am liable for intent and gross negligence. I am not liable for slight negligence, except for personal injury and liability under the Product Liability Act.
10. Applicable law and jurisdiction
Swiss law applies. Jurisdiction is determined by the statutory provisions. For consumers, the mandatory places of jurisdiction under the Swiss Civil Procedure Code apply.
Privacy policy
This section explains which personal data I process, why, and who receives it. The Swiss Federal Act on Data Protection (FADP) applies.
Controller
Montana Meyer, Rough Bloom Ceramics, address see legal notice, hello@roughbloom.ch.
What data and why
- Orders: name, delivery address, email, and the pieces ordered. I need this to process your order, keep you informed about shipping and keep my accounts.
- Payment data: you enter card and account details directly with the payment provider. I do not see or store them.
- Email and phone: if you write to me or call, I process your details to reply.
- Visiting the website: the web server logs technical details such as IP address, date and time, the page requested and browser type. This is needed to run the site securely.
The website itself sets no cookies and uses no analytics or advertising tools and no newsletter. During ordering and payment, the payment provider may set technically necessary cookies. The font is stored on the site's own server; loading the page sends no data to Google or other third parties.
Who receives data
- Hosting and email: Infomaniak Network SA, Geneva, Switzerland. This data stays in Switzerland.
- Payment: Stripe Payments Europe, Limited, Dublin, Ireland, processes the payment (card, TWINT, Klarna). For this, Stripe receives your name, email, delivery address and payment details.
- Klarna: if you pay with Klarna, Klarna Bank AB (publ), Stockholm, Sweden, checks your identity and creditworthiness under its own responsibility.
- Shipping: Swiss Post Ltd, Bern, receives your name and delivery address.
- Accounting and authorities: where required by law.
I do not sell data or pass it on for advertising.
Disclosure abroad
For payment, data goes to Ireland and Sweden (EU) and to Stripe, LLC in the USA. The Swiss Federal Council has found that the EU provides an adequate level of data protection. Stripe, LLC is certified under the Swiss-U.S. Data Privacy Framework; since 15 September 2024, certified US companies are also considered to provide adequate protection.
How long
I keep order and invoice data for as long as commercial and tax law retention rules require, usually ten years. Other messages are deleted once they are no longer needed. The host deletes server logs automatically after a short time.
Your rights
You can ask at any time what data I hold about you, have incorrect data corrected and have data deleted unless I am required to keep it, and receive your data in a common electronic format (Art. 25, 28 and 32 FADP). Just write to hello@roughbloom.ch. If you think I am not handling your data correctly, you can contact the Federal Data Protection and Information Commissioner (FDPIC).
Changes
I update this policy when something changes. The current version on this page applies.
